OVERVIEW
Welcome to the HaljalaNgu online store! This online store is owned and operated by NGU CLOTHES OÜ (hereinafter “HaljalaNgu”, “we” or “us”). HaljalaNgu offers products and services through this website (hereinafter the “Services”). The technical operation of the Services is provided via the Shopify platform.
These Terms and Conditions (hereinafter the “Terms”) govern the use of the Services and define the rights and obligations between you and HaljalaNgu.

If you do not agree to the Terms, please do not use the Services.
SECTION 1 – ACCESS AND ACCOUNT
To use the Services, you must be at least 18 years old or have the consent of a legal guardian. When using the Services, you may be required to provide personal data, including contact, payment, and delivery details. You confirm that all information provided is accurate, complete, and up to date.
You are responsible for the security of your account and for all activities carried out through your account. Transferring, selling, or reselling your account to third parties is not permitted.
SECTION 2 – PRODUCTS
HaljalaNgu makes reasonable efforts to ensure that the products displayed on the website are presented as accurately as possible. However, product colors and details may vary depending on the device and settings used.
All product descriptions, prices, and availability are subject to change without prior notice. HaljalaNgu reserves the right to limit quantities or remove products from sale.
SECTION 3 – ORDERS
By placing an order, you submit a purchase offer. The sales contract is deemed concluded once the order confirmation has been sent by email.
Purchases are intended for personal use only. Resale without prior written consent from HaljalaNgu is not permitted.
SECTION 4 – PRICES AND PAYMENT TERMS
All prices are stated in euros. Prices do not include shipping, customs duties, or other additional charges unless stated otherwise.
To place an order, the desired products must be added to the shopping cart. To complete the order, the required data fields must be filled in and a suitable delivery method selected. The total amount payable will then be displayed, which can be paid securely using the following payment methods:

NB! When paying via bank link, you must click the button “Return to merchant” on the bank’s page.
Payments are processed by Maksekeskus AS. Payment takes place outside the Online Store in a secure environment: bank link payments are processed in the secure environment of the respective bank, and card payments are processed in the secure environment of Maksekeskus AS. The seller does not have access to the customer’s bank or credit card details.
The sales contract enters into force once the amount payable has been received in the HaljalaNgu bank account.
The owner of the online store, HaljalaNgu, is the controller of personal data and forwards the personal data necessary for payment processing to the authorized processor Maksekeskus AS.
If the ordered goods cannot be delivered due to the product being out of stock or for any other reason, the customer will be informed as soon as possible and the paid amount, including delivery costs, will be refunded without delay, but no later than 14 days from the date the notice is sent, in accordance with applicable law.
The order will not be processed or shipped until payment has been successfully received. If payment fails, is cancelled, or reversed, HaljalaNgu reserves the right to cancel the order.
HaljalaNgu does not store payment card details. Payment processing is handled by Shopify and its authorized payment service providers.
SECTION 5 – SHIPPING INFORMATION
Available shipping methods, shipping costs, and estimated delivery times are displayed at checkout before the order is confirmed.
Delivery times are estimates and may vary in exceptional cases depending on the destination, carrier, customs procedures, or other circumstances beyond HaljalaNgu’s control. HaljalaNgu makes reasonable efforts to ensure timely delivery.
The risk of accidental loss or damage to the goods transfers to the customer at the moment the customer or a third party designated by the customer physically takes possession of the goods.
The customer is responsible for providing accurate and complete delivery details. HaljalaNgu is not responsible for failed delivery due to incorrect or incomplete information provided by the customer.
If the goods are not delivered within a reasonable time, the customer has the right to exercise remedies provided by law.
SECTION 6 – RIGHT OF WITHDRAWAL (CONSUMER RIGHT)
If you are a consumer within the European Union, you have the right to withdraw from the contract within 14 dayswithout providing any reason.
The withdrawal period expires 14 days from the day on which you or a third party designated by you (other than the carrier) acquires physical possession of the goods.
To exercise the right of withdrawal, you must submit a clear statement by email to info@haljalangu.eu before the withdrawal period expires.
Effects of Withdrawal
If you withdraw from the contract, we will refund all payments received from you, including standard delivery costs (excluding additional costs resulting from your choice of a delivery method other than the least expensive standard delivery), no later than 14 days from the day on which we are informed of your decision to withdraw.
We may withhold reimbursement until we have received the returned goods or you have provided proof that the goods have been sent back.
Return of Goods
The goods must be returned no later than 14 days after submitting the withdrawal notice. The direct cost of returning the goods shall be borne by the customer unless stated otherwise.
The customer is liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
Exceptions to the Right of Withdrawal
The right of withdrawal does not apply to:

goods made to the consumer’s specifications or clearly personalized;

sealed goods which are not suitable for return due to health protection or hygiene reasons, if the seal has been removed;

other cases provided by law.
SECTION 7 – INTELLECTUAL PROPERTY
All content of the Services, including texts, images, logos, and designs, is the property of HaljalaNgu or its partners and is protected by applicable intellectual property laws.
SECTION 8 – OPTIONAL TOOLS
HaljalaNgu may provide access to third-party tools on an “as is” basis. Use of such tools is at your own risk.
SECTION 9 – THIRD-PARTY LINKS
The Services may contain links to third-party websites. HaljalaNgu is not responsible for the content or activities of such websites.
SECTION 10 – RELATIONSHIP WITH SHOPIFY
The HaljalaNgu online store operates on the Shopify platform. All sales transactions are conducted between HaljalaNgu and the customer. Shopify is not responsible for sales transactions or their fulfillment.
SECTION 11 – PRIVACY
Personal data is processed in accordance with our Privacy Policy and applicable data protection laws.
SECTION 12 – FEEDBACK
Feedback provided by the customer may be used by HaljalaNgu without compensation or restrictions, provided it does not infringe the rights of third parties.
SECTION 13 – ERRORS AND INACCURACIES
HaljalaNgu reserves the right to correct errors or inaccuracies or to cancel orders if the information provided is misleading.
SECTION 14 – PROHIBITED USE
The Services may only be used for lawful purposes. Misuse of the Services, security breaches, and malicious activities are prohibited.
SECTION 15 – TERMINATION
HaljalaNgu may terminate the use of the Services at any time. Certain provisions of the Terms will remain in force after termination.
SECTION 16 – DISCLAIMER OF WARRANTIES
The Services are provided “as is” to the extent permitted by applicable law. This section does not limit statutory consumer rights.
SECTION 17 – LIMITATION OF LIABILITY
HaljalaNgu’s liability is limited to the maximum extent permitted by law. This section does not limit liability that cannot be excluded by law.
SECTION 18 – INDEMNIFICATION
You agree to indemnify HaljalaNgu and Shopify for damages arising from breaches of the Terms or unlawful use of the Services.
SECTION 19 – SEVERABILITY
If any provision of the Terms is found to be invalid, the remaining provisions shall remain in effect.
SECTION 20 – ENTIRE AGREEMENT
These Terms constitute the entire agreement between you and HaljalaNgu.
SECTION 21 – ASSIGNMENT
You may not assign your rights or obligations without the prior written consent of HaljalaNgu.
SECTION 22 – GOVERNING LAW
These Terms are governed by the laws of the Republic of Estonia.
SECTION 23 – HEADINGS
Headings are included for convenience only and do not affect the interpretation of the Terms.
SECTION 24 – CHANGES
HaljalaNgu may update the Terms. Continued use of the Services constitutes acceptance of the updated Terms.
